French lesbian wins 10-year adoption fight
November 12th, 2009
A ten-year legal battle has ended in victory for a French lesbian couple trying to a adopt a child.
48-year old ‘Emmanuelle B’ applied to adopt a child in 1999. She applied as an individual but did not hide her relationship with another woman, and was repeatedly turned down, as France currently does not allow same-sex couples to adopt.
A court in Besançon, eastern France has now overturned two previous rulings and allowed Emmanuelle B to adopt.
The European Court of Human Rights backed Emmanuelle B’s case, supporting her claims that she was a victim of discrimination.
Nicolas Sarkozy’s government has responded to the ruling by reiterating its continued opposition to adoption by gay couples.
