‘Dyke’ couple attacked on night out

Two brothers have admitted attacking a lesbian couple and calling them ‘dykes’ on a night out in Burton town centre.
Robert Slater, 18, and his 21-year-old brother Johnathan Slater, both of Harwood Avenue, Branston, confessed to assault causing actual bodily harm to Charlotte Hall. Johnathan also admitted common assault on Hall’s fiancée Hayley Galli, as reported in the Burton Mail.
The couple were enjoying a night out in October last year when the brothers began to verbally abuse them, Stafford Crown Court heard.
Robert Slater then punched Ms Hall in the neck and face, wrestling her to the ground, Pat Sullivan, prosecuting, told the court.
His brother also joined in and elbowed Ms Galli in the head. After the attack, Johnathan Slater called the pair “dykes”.
The court heard how Ms Galli had shouted “‘don’t hit her – she’s a woman”, only for Robert Slater to respond “no it ain’t”.
As a result of the attack, which was captured on CCTV in the town, Ms Hall spent a night in hospital with suspected concussion and other injuries.
Despite using the word ‘dyke’ as an insult, Judge Simon Tonking told the court that this was a “throwaway remark” and claimed the fight did not occur for this reason.
He said: “This was a joint offence of violence in the street at night, which led to a female victim suffering injuries to her face, bruising to her lip and a bleeding nose. The woman who came to her aid, you Johnathan, deliberately elbowed in the head.”
Defending, Darron Whitehead, said the attack was out of character for the brothers and they were deeply ashamed.
Robert Slater was given an eight-month youth custody sentence, suspended for two years, and was ordered to do 200 hours community work, paying Ms Hall £500 compensation and £300 costs.
Johnathan Slater received a four-month youth custody sentence, also suspended for two years, with 150 hours community work, £500 compensation to Ms Hall, £200 to Ms Galli, plus £300 costs.
